These terms apply when visiting the Niskai Aquatics website, using its content, or purchasing products through the online store.
Wholesale customers
Wholesale orders have additional conditions.
Wholesale orders are also subject to the Wholesale Terms & Conditions. If the two documents differ on a wholesale-specific matter, the Wholesale Terms & Conditions apply to that matter.

Using this website
The website, online store and other published material are provided for lawful use. Do not interfere with the website, scrape it at scale, attempt unauthorised access, or use its content in a misleading or unlawful way.

Orders and availability
Submitting an order is an offer to purchase. An order is accepted when Niskai Aquatics confirms it. Products remain subject to availability. If an accepted order cannot be supplied, the customer will be contacted and offered an appropriate solution, which may include a substitute agreed with the customer or a refund.

Prices and payment
Prices are displayed in Australian dollars. Applicable delivery charges and any other amount payable will be displayed or agreed before the order is confirmed. Payment must be made using a method offered at checkout or otherwise agreed directly with Niskai Aquatics.

Dispatch and delivery
Retail orders are generally processed within 7 business days unless another lead time is stated. Processing time is separate from carrier transit time. Delivery dates are estimates, not guarantees. Customers will be informed of known material delays as soon as reasonably practicable and provided with an appropriate solution where an order cannot be supplied on time or within a reasonable time.

Problems, returns and refunds
If a product is faulty, unsafe, damaged, not as described, or otherwise fails to meet an applicable consumer guarantee, contact Niskai Aquatics with proof of purchase and reasonable evidence of the problem. The available remedy may be a repair, replacement, refund or another remedy required by law. Change-of-mind returns are not offered unless expressly agreed.

Product use and aquarium outcomes
Follow product labels, feeding directions, storage instructions and reasonable aquarium-care practices. Aquarium outcomes depend on many factors outside Niskai Aquatics’ control. A remedy may not be available where a problem was caused by unreasonable misuse, improper storage, overfeeding, an unsuitable setup, or use contrary to supplied instructions.

Information and advice
Articles, guides and general advice are provided as educational information and are not a guarantee of a particular result. Customers remain responsible for assessing the needs of their aquarium and livestock. Contact Niskai Aquatics if product-specific guidance is required.

Intellectual property
Website copy, photographs, graphics, product artwork, logos, branding and other original materials belong to Niskai Aquatics or their respective rights holders. They may not be reproduced, altered, sold or used commercially without permission. Retailers may use approved assets supplied by Niskai Aquatics in accordance with the Wholesale Terms & Conditions.

Liability
To the maximum extent permitted by law, Niskai Aquatics is not responsible for loss caused by improper product use, unreasonable misuse, failure to follow supplied directions, or aquarium conditions outside its reasonable control. This limitation does not apply where liability cannot lawfully be excluded or limited.

Changes to these terms
These terms may be updated from time to time. Changes apply from the updated date shown on this page and do not retrospectively alter an order already accepted unless the customer agrees or the change is required by law.
